This site is owned and operated by Smoke Cartel. Your privacy is of the utmost importance to us.  We've partnered with Shopify to present a safe, secure, and easy shopping experience.

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

Information You Provide

When you contact us through our Site, register and set up an account on the Site, inquire about our Affiliate Programs, register for our newsletter, utilize our private chat, or make a purchase on our online store, we collect certain personal information from you, such as your name, email address, postal address, phone number, credit card data, and other information you may provide to us via the Site.  We may use this information to communicate with you, to provide information about our products, services, or business, or to process a transaction.  Any communication through our private chat function will be recorded in full and kept in keeping with this policy. We may also use this information in our legitimate business interests, such as for marketing purposes or to provide information about products or services that may be of interest to you. Unless you expressly opt out of any specific method of communication, which is not a condition of any purchase, we may send text messages and emails to you to promote our products, including by automated systems.  We keep your information only for as long as is reasonably necessary for the purposes for which it was collected.

Other Information We Collect

In addition to collecting information directly from you as described in the previous section, we also automatically gather information when you browse or view our Site. This information may include Internet Protocol (IP) address, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, clickstream data, whether you are a first-time or a returning user, links you clicked on while in the Site, and your flow and navigation path through the Site.  We use this information to make sure that the Site and its associated parts are functioning properly, that the Site is displayed properly for your equipment and software, and that we can provide you with information useful to you and your location.

In some of our email messages, you will find a “click-through URL” linked to content on our Site. We track this click-through data to help us determine interest in particular topics and to measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click on such links.

 

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates. 

SECTION 2 - CONSENT

If you believe that the Personal Information that we have collected about you is incomplete, inaccurate, or not up to date, or if you would like to review and/or request changes or deletion of that information, you can contact our Webmaster.

If you do not consent or want to withdraw your consent for us to collect, use, or disclose your Personal Information as described in this Policy, please contact our Webmaster. In your request, please identify the Personal Information at issue and the collection, use, or disclosure you wish to stop.

Denying or withdrawing consent may not allow us to provide you with some or all of the products, services, or information you request.

You may opt-out of receiving marketing-related emails or text messages by clicking the “unsubscribe” link at the bottom of any email you receive from us or opting out of additional text messages by following the instructions in a text, or else by emailing us at contact@smokecartel.com. Consent to marketing related emails or text messages is not a condition of any purchase.  If you are having difficulty unsubscribing from our marketing communications, please contact us at contact@smokecartel.com.

If you opt-out from receiving marketing emails or text messages, we may still need to send you communications about your account, orders, customer service inquiries, employment inquiries and other transactional, business related matters.

If you agree to receive future marketing communications directly from a third party through our Site, you will need to contact that party to opt-out of such communications. This process may be outlined on that party’s privacy policy.

 

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. We also disclose your information to our service providers for the purposes of facilitating your transactions and experience on our website.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. 

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. 

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.  

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by them.  

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

SECTION 7 - COOKIES

 Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

 _session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).

 _shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.

 _secure_session_id, unique token, sessional

 storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.

SECTION 8 - AGE OF CONSENT

 By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Our Site is not directed to children under age 13 and we do not knowingly collect Personal Information from children under the age of 13.  Children under 13 should not provide their Personal Information to us through our Site, to customer service, or in writing.  If we learn that Personal Information belonging to anyone under the age of 13 is stored on the Site, we will immediately delete such information and refrain from using it for any purpose.

 

SECTION 9 – DATA MANAGEMENT

We may maintain your Personal Information on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

We process data, including Personal Information, in the United States.  We transfer your Personal Information to another organization or a country only with your consent or to perform a contract with you, and consistent with the practices described in this Privacy Policy.

 

SECTION 10 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
